Minutes of the Special Meeting
May 31, 2008

The North Carolina State Board of Examiners in Optometry met by way of a conference telephone call at 2:00 P.M. on Friday, May 30, 2008 for a Special Meeting properly noticed to take the place of a Formal Hearing previously noticed to take place in Raleigh, North Carolina beginning at 9:00 A.M. on Thursday, May 29, 2008. Present on the call were Drs. David Anderson, President, William Hendrix, Secretary/Treasurer, Joel Banks, William Rafferty and Mr. Roger Mitchell and Ms. Mary Richardson, Members of the Board. Also present were Johnny M. Loper, the Board’s attorney, Mr. James Wilson, Special Counsel to the Board and Dr. John Robinson, the Board’s Executive Director.
At 2:05 P.M. following a roll call by the Executive Director Dr. Anderson called the meeting to order. Noting for the record that he had previously recused himself in the matter now before the Board and that he would not participate in these deliberations, he called upon Dr. William Rafferty to be the presiding officer.
Dr. Rafferty then called on Mr. Loper for the report of the Probable Cause Committee.
Mr. Loper reported on one investigative case, and informed the Board of the Committee’s recommended resolution of that matter. After Mr. Loper’s report, Dr. Rafferty opened the floor for questions. Mr. Loper, Dr. Robinson, and Mr. James Wilson, Special Counsel to the Board, responded to the Board’s questions. Dr. Clark then moved and Mr. Mitchell seconded a motion that the Committee’s report and recommendation for resolution be accepted and effected. The motion carried. The specifics of this report, recommendation, and action are not included because these actions are not public records or public information
There being no further business, Dr. Banks moved and Ms. Richardson seconded a motion that the meeting be adjourned. The motion carried unanimously.
The next regularly scheduled meeting of the Board will be at the Embassy Suites Hotel at Kingston Plantation in Myrtle Beach, South Carolina beginning at 8:30 A.M. on Thursday, June 5, 2008.
